Family Medical Leave Information

The Family and Medical Leave Act (FMLA) provides employees with up to 12 weeks of unpaid, job-protected leave per year. During your leave your health insurance shall be maintained. The Collective Bargaining Agreement (CBA) addresses the FMLA under Article 16, Section 7. In order to be eligible for Family Medical Leave (FML) you must have worked for BIW a minimum of 12 months, during which you had worked a minimum of 1,250 hours.

FML can be utilized for any of the following reasons:

  • For the birth and care of the newborn child of an employee.
  • For the placement with the employee of a child for adoption or foster care.
  • To care for an immediate family member (i.e., spouse, child, or parent) with a serious health condition.
  • When an employee is unable to work because of a serious health condition.

Supervision is required to ensure BMDA employees have the appropriate absence code applied to their Family and Medical Leave. The CBA covers absence codes under Article 34, Section 1.

Family and Medical Leave will be automatically utilized when out under the Accident and Sickness plan. Employees may utilize banked sick leave while out on FML in accordance with Article 16, Section 2 of the CBA.
