Growing Graduate Employee Movement Pursues Collective Bargaining Rights at Private Universities

NEW YORK, NY — Unions seeking representation for more than 3,000 research and teaching assistants (RAs and TAs) filed certification petitions with the National Labor Relations Board (NLRB) today. Graduate Workers of Columbia (GWC-UAW), the union for 2,800 Columbia University RAs and TAs, and Student Employees of New School (SENS-UAW), the union for over 350 RAs and TAs at the New School, filed petitions at the Manhattan NLRB office to become part of the UAW.

CHATTANOOGA, Tenn. — Gary Casteel, secretary-treasurer of the UAW, who heads the International Union’s Transnational Department, today released the following statement regarding Volkswagen's verification of the membership of UAW Local 42:

"We appreciate Volkswagen's timely response in verifying UAW Local 42’s substantial membership level, which exceeds a majority of workers at the plant.

“As anticipated, we surpassed the highest level under Volkswagen's new Community Organization Engagement policy, and the local leadership is ready to move forward with additional conversations with the company. It was brought to my attention today by management that at MGM some dealers are defying the contract language when it comes to beards now being allowed @ MGM. It's not so much that they are concerned about the length guidelines, its how they are being maintained. Please keep them neat as we don't want to make a big issues out of this.

Retro checks will be available  this friday for employees whom have direct deposit. Employees with live checks will obtain there retro as a regular live check on monday. With the checks will come information concerning the wellness program.

Update on the retro check

I was informed by management that the checks will be released next week. They want to make sure that all employees hours are calculated perfectly.

Also with this retro check will be information on the release of the new wellness program.

I have also been informed that if any employee who goes through the swipe process in the cafe and does not see what they want or like they may swipe again. But you MUST first speak to the Head Chef on duty.

I have just received an email from management concerning the licensing renewal concerns we have with the MGM side. The response I obtained stated that as soon they can they will have a representative on this side to handle this process for our employees.

An update from the scheduling office. Approximately 30% of grave shift on the MGM side and 70% at Foxwoods. We have been informed that next week there will be some licensing personal over on the MGM side for swing shift. I know it's not a perfect situation or world but we are doing our best to keep everyone in the loop on this issue.

 It's with great sadness that we must report the passing of long time Foxwoods Dealer Katie Dion Vacca. She was such a sweet and highly energetic young lady whom will be sadly missed by all.

After Contract Concerns And Questions

We have had numerous calls and comments concerning the contract and what is going on with it. I will highlight the major issues that have been brought to our attention:

1) The biggest question of all is the retro check. When will we be getting it? Our Attorney Dan Livingston is working with management to resolve this ASAP. It will be computed by the actual hours that you worked for the weeks from March 1, 2012 – August 31, 2013.

2) When does the contract go into effect? The contract goes immediately into effect once we notified management of our
decision.

3) Facial hair? Some employees from the MGM side have asked the question, when can we begin to grow our hair? The policy states that you must grow it on your own time and in accordance with the contract. Please use common sense with this issue.

4) When and how does the new medical plan go into effect? This is something that the company will implement and provide all the employees with the necessary info. You will be allowed to attend the physician of your choice and all information will be confidential between you and your provider. Please do remember that you must remain in compliance so that your basic plan fee does not increase.

5) Many have asked and are concerned about the treatment we obtained from many of the managers after we ratified our last contract. I had a conversation with Mr. Leone about this issue a couple of weeks ago and he assured me that these sort of behaviors will not be tolerated nor will they occur.

During our monthly Executive Board meeting we were discussing the exclusion list within our MPTN Medical Plan. This list states that if you are injured while para sailing, bungee jumping, driving a motorcycle or car in an erratic and in a defensive manner your medical claim will be denied. This list is more extensive and is absolutely absurd.

My point with this issue is that both Bob DeMello and John Delmonte brought up a very good point. How the heck can you have an exclusion list when the company allows for the most lethal means of personal harm and increased medical claims, and they pay the bills.

I would like to thank all the employees whom attended our first ever membership meeting held at Foxwoods. A huge thank you goes out to the bargaining committee, Dan Livingston our attorney and Karen Rosenberg our local 2121 service rep. Without their hard work, time, effort and creative thinking this never would have come to a finalization.

Obviously all who attended were very interested in the contract and the specifics associated with it. It was great to see that many were very open minded and receptive to what the bargaining committee was able to accomplish by withstanding the pressures of management.

We will be having 5 upcoming meetings on 8/14, 8/16, 8/19, 8/22 and 8/28 @ the following times: 10:00 a.m. 12:15 p.m. 4:00 p.m. and 6:30 p.m. All these meetings will be held at Foxwoods. We have yet to firm up the location but will post as soon as we are notified. This will be your time to have any question answered concerning the contract and your personal needs.

The ratification vote will be held on 8/29 & 8/30 at both the MGM & Foxwoods in a room to be determined.

We reached a tentative agreement with Foxwoods yesterday, which we are unanimous in recommending to our members.

We did not achieve everything we wanted, but we are proud that in tough economic times, we have been able to move forward—when so many other workers are unfortunately falling behind. We won a pay increase retroactive to March 1, 2012 and increases for each year of the contract. We held down and delayed increases in health insurance premiums and won a Wellness program that will keep us healthy and put more money in our pockets. We preserved the 401k match, our weekend RDOs, our full-time and dual rate ratios, and caps on casual usage—which means promotional opportunities for our part-time members. We upheld the principle that the dealers alone get to decide on any change in our toke distribution method. We have also made further improvements in the air quality at work.

The following are some highlights of the tentative agreement. Some of the tentatively agreed language is still being finalized, but we will shortly have a detailed summary as well as actual contract language available. We will be holding five day-long series of informational meetings at Foxwoods, leading up to a two-day ratification vote at Foxwoods/MGM on August 29 and 31. In between, we will be in the casino to answer members’ questions.

We hope you will come to an information session, get informed and show up to ratify this contract.

DAILY TOKE Preserved the principle that only the dealers have a right to decide how to distribute our tokes. The dealers will have a chance to take an informed vote on moving to a daily toke. If the dealers approve a daily toke, there will be a rebid on RDOs.

HEALTH INSURANCE Dollar cap (instead of percentage premium share management wanted).
Premium share lower than the 20% management wanted (and 25% for casuals and new employees!)
Rate increases which have already been implemented for other team members will be phased in:

We won a voluntary Wellness program which will help us stay healthier and hold down costs.

• Participants who comply with requirements will avoid higher premiums and receive a rebate of 7.5% of their annual health insurance premium starting January, 2015.
• Participants will also save because there will be no co-pay for any required screenings, exams and treatments free (no co-pays).
DENTAL No rate increase.
401K PRESERVED! No further suspension.
RATIOS
PRESERVED minimum full-time and dual rate percentages and cap on allowable percentage of casuals—protecting promotional opportunities for part-timers.

WEEKEND RDOS* Preserved guaranteed minimum percentages of weekend RDO pairs (and equalized across Foxwoods/MGM table games).

ARBITRATION PRESERVED right to arbitrate all discipline.

SECOND-HAND SMOKE Set minimum levels of outside air replacement double the current levels.

CASUALS • 1 personal day per year (retroactive to January 1, 2013).
• Paid Vacation and sick leave (implemented earlier this year).

REGULAR PT STATUS PRESERVED 20 hrs/week minimum to maintain regular part-time status.

PART-TIMERS Tighter restrictions on temporary usage and ability of temps to pick up shifts.
Part-timers have the right to take outside work dealer jobs.

DUAL RATES No more dot floor shifts. 2 shift/week minimum, 3d shift assigned by seniority.
Dual rates extras will be paid flooring rate for whole shift if they are suited up.

VASTECH ACCESS Internet access to VASTECH so dealers/dual rates can check their schedules, pick up and give away shifts without having to travel to the casino.

MGM Heated outdoor smoking area.

POKER Increased special assignment and toke subsidy to be a blend of live action and tournament rates.

APPEARANCE STANDARDS Beards/mustaches allowed across property.
MEDICAL LEAVE Delays by ESIS/Workers Comp don’t count against leave.

STREAMLINED RANKING SYSTEM Making it easier to pick up and give away shifts.

After speaking to management this morning, the women within our bargaining unit will no longer be allowed to exchange their shirts for the mens version. This will take effect this Friday 8/02/2013.

As we move forward with change and redevelopment I can assure all that our Executive Board and elected officials are working hard to create positive change in order to effectively move forward and allow for people to have trust and faith in our local. I am a different type of leader and thinker and with the changes made on the elected level we now have a team in place that I’m sure with time all will be pleased with the new way in which we operate.


I am aware of some whom have zero faith in unions and what their foundation is based on. And I will be the first to admit that not ever will everything be perfect. But the major concern that I have is that with negativity comes rumors, of which 99.9% of the time are false. My point is, if there is ever a doubt in anyone’s mind concerning whatever it may be please just pick up the phone and call the office ( 860-892-9191 ). All I ask is please give this new team a chance and time and I assure you our employees will have a more favorable outlook with our union. Change takes time and with the changes that we are incorporating there is a process that must be followed in order to implement and finalize the final product.


The first and of most component of our local is communication. Drew is now in the process of forming a committee to get the flyer up and running. And when completed it will be published in a monthly manner with a wide variety of topics and commentary.
Many other types of committees will be formed in the future but it’s imperative that we create and focus on the flyer and build on this endeavor. I have met with the Norwich Chamber of Commerce to become more involved with the community and its activities. As I told Drew and Chris Messenger the other day, as they kill me, I have committed the UAW to the River Raft Race held in Norwich annually in June. We will build this ourselves and then most likely sink the raft in the Thames River. But the idea is to create fun and togetherness for our members of Local 2121. Also we are in communication with Reliance House Inc. along with the Chamber to put on a 5k Road Race in conjunction with the Norwich Winter fest parade the Saturday after Thanksgiving. The thought as I type this is to bring in the Hartford Marathon Foundation to basically run the process of this event and diminish the necessary man hours to operate an event such as this. The idea of this race is to again get us more involved with the community and create a positive image for our local and unions in general.
I know many may say this is all well and good but what about our contract. This process is in the hands of the arbitrator, but with that said, we continue to meet off the record with management with a hopeful outcome being a finalized contact. If the bargaining committee agrees on a contact then you the members will have the right to either accept or reject this proposal.
